Telmark, LLC, et al. v. Grunder, 305 A.D.2d 981 (4th Dep't 2003)

Telmark, LLC was the lessor of certain farm equipment. Upon the obligor's default, Telmark pursued its remedies against the defendant, as guarantor. The lower court limited Telmark's right to recover against the guarantor. On appeal, the lower court was reversed and Telmark was permitted to recover against the guarantor without condition. This action addressed issues under U.C.C. article 2-A that otherwise have limited reported cases. Kevin M. Newman and Julian B. Modesti represented Telmark, LLC.
