  • Successfully prosecuted complex pharmacy and medical malpractice claim against SUNY Health Science Center in Syracuse. It was alleged that the pharmacy and pediatric oncology department of SUNY Health Science Center erred in providing intrathecal chemotherapy to a 7 year old boy resulting in unexplained paralysis. Although the exact cause of the paralysis was never identified, expert witnesses were able to establish the likelihood of inadvertent contamination of chemotherapy drugs and the statistical improbability that paralysis would result in the absence of contamination. In what is believed to be the largest settlement of a personal injury case in the Court of Claims outside of New York City, the sum of $4 million was received, a portion of which was invested in a structured settlement. Assuming the Claimant lives to age 75, he will have received $44 million in tax free payments.
  • Resolved claim charging that a 2 year old girl had been burned as a result of negligent supervision by foster parents selected, trained and supervised by Onondaga County DSS. In a settlement valued at more than $2 million, an annuity will provide the Plaintiff with more than $15 million dollars tax free over her lifetime.
  • Trial of an action involving unique injuries to a motorcyclist who sustained closed head trauma. As a result of damage to the frontal lobes of the motorcyclist’s brain, his inhibitory controls were impaired resulting in inexplicable, and often criminal, outbursts when faced with even minor annoyances or frustrations. By presenting neuropsychological data and expert testimony during a 3 week trial, a result was achieved guaranteeing payments to the accident victim of nearly $1.2 million.
  • Following a three week trial, obtained verdict in excess of $6,000,000 against municipality in a police shooting case. Included in the verdict was a $4.5 million pain and suffering award to estate of a 40 year old woman fatally shot by police officers during a hostage situation and $1 million award to the victim’s brother for emotional distress from being in the “zone of danger” during the shooting.
  • Jury verdict of $1.8 million was awarded to a New York City firefighter who fell down stairs during a training exercise. In this action it was established that the City of New York violated State and Local building codes in its negligent installation of the hand railing of the stairwell overcoming the “firefighters rule” which prohibits claims by firefighters and police officers for ordinary negligence.
  • Settlement of $1.1 million for 44 year old man who fell from an elevated worksite. It was proven that the general contractor and owner failed to provide proper fall protection devices as required by New York’s Labor Law and Industrial Code.
  • $2 million settlement in medical malpractice action alleging misdiagnosis of breast cancer.
