In re Larry Beam, dba B&B Metals

Menter, Rudin & Trivelpiece, P.C. represented a leasing company in this case before the Bankruptcy Court for the Central District of Illinois. The leasing company leased two buildings to the debtor. One of the building leases was secured by a mortgage on the underlying real estate. The leasing company filed a motion to allow post petition unpaid rent as a priority claim and directing the debtor to immediately pay this rent. The issue before the court was whether the leases were true leases as urged by the leasing company or disguised sales as contended by the debtor. The court held the leases were true leases. The leasing company’s attorney was Kevin M. Newman.
