In re Cecil Edward Byrnes, dba Byrnes Centennial Dairy Farm

Menter, Rudin & Trivelpiece, P.C. represented a leasing company in this case in the Bankruptcy Court for the Eastern District of Michigan. The leasing company sought an order compelling the debtor to assume or reject the lease of a building, make lease payments and granting related relief. The debtor opposed the motion and contended that the lease was not a true lease. The court decided in the leasing company's favor and held that the lease was a true lease to be assumed or rejected by the debtor. The leasing company’s attorney was Kevin M. Newman.
