In re Ames Department Stores, Inc.

Menter, Rudin & Trivelpiece, P.C. represented shopping center developers that were landlords of Ames in this bankruptcy case filed in the Southern District of New York. The court decided in favor of one of the developers and upheld the enforceability in bankruptcy of a lease provision permitting the developer to elect percentage rent due based on previous sales of inventory from the premises when the premises are vacated. The court directed Ames to pay the percentage rent at issue to the developer. The developers’ attorney was Kevin M. Newman.
