In re Agway, Inc., 313 B.R. 31 (Bankr. N.D.N.Y. 2004)

The Court upheld Agway's objection to a claimant's motion for permission to file a late claim, holding that for purposes of a proof of claim bar date, a claim may exist under the bankruptcy code, thus requiring the filing of a proof of claim, even though no claim has accrued under state law. Agway and the Liquidating Trustee were represented by Jeffrey A. Dove and James C. Thoman.
