In re Agway, Inc., 2006 Bankr. Lexis 3648 (Bankr. N.D.N.Y. 2006)
The Court held that notwithstanding the pending state court liquidation proceeding of an insurance company claimant against Agway, the McCarran Ferguson Act (15 U.S.C. §§1011-1015) did not act to deprive the bankruptcy court of jurisdiction to determine Agway's objections to the insurance company's claims filed against Agway. Jeffrey A. Dove, Mitchell J. Katz and James C. Thoman represented Agway and its Liquidating Trustee in the case.
