Niagara Mohawk Power Corp. v. Consolidated Rail Corp., et al., 306 F.Supp. 2d 282 (NDNY 2004)
Firm's attorneys successfully defended Consolidated Rail Corp. in a contribution case brought by Niagara Mohawk under CERCLA. Summary judgment was obtained in favor of Consolidated Rail Corp., successfully establishing that it was not responsible for contributing to coal tar and related contamination at a former Manufactured Gas Plan site adjacent to a railroad line in Troy, New York.
